Cryptoback Programme – Terms and Conditions

1. Welcome

1.1 This page sets out the terms and conditions that apply to the Wirex "Cryptoback" rewards Programme (the "Cryptoback Programme").

1.2 By participating in the Cryptoback Programme, you shall be deemed to have accepted these terms and conditions ("Cryptoback Terms").

1.3 Please read these Cryptoback Terms carefully and make sure you understand and agree to them before you participate in the Cryptoback Programme.

1.4 The Cryptoback Programme is void where prohibited by law.

2. Who we are

2.1 The Cryptoback Programme is sponsored, promoted and administered by Wirex Limited and our affiliates. Wirex operates a platform that allows users to buy, sell and manage various supported currencies and cryptoassets, as well as to apply for, manage and load money onto a Wirex payment card (collectively, the "Wirex Service").

2.2 The company that sponsors, promotes and administers the Cryptoback Programme is the Wirex company that provides the Wirex Service to you, as set out in paragraph 3 of the Wirex General Terms of Service above ("Wirex", "we", "our", or "us").

3. Eligibility

3.1 The Cryptoback Programme is open to anyone who has registered with us, set up a profile on the Wirex Service (a "Wirex Profile"), and applied for and received a physical pre-paid debit card from us or one of our affiliates (the "Wirex Card"), except:
(a) employees of any of our group companies;
(b) employees of any company that issues the Wirex Card;
(c) employees of any other organisation involved in the preparation or administration of the Cryptoback Programme;
(d) anyone else professionally connected with the Cryptoback Programme; or
(e) the immediate family members of any of the above.

4. How to participate in the Cryptoback Programme

4.1 In order to participate in the Cryptoback Programme you must:
(a) hold a valid, current physical Wirex Card in your name; and
(b) use that Wirex Card to make an in-store purchase (a "Qualifying Purchase").

4.2 Subject to paragraphs 5 and 6, for each Qualifying Purchase that you make with your physical Wirex Card, we will credit your Wirex Profile with an amount of Bitcoin equivalent to half a percent (0.5%) of the value of the Qualifying Purchase, calculated by reference to the prevailing market rate at the time you make the Qualifying Purchase (the "Cryptoback Reward").

5. How will the Cryptoback Reward be paid?

5.1 We will hold the Cryptoback Reward on your behalf until you tell us that you would like to withdraw it to a crypto wallet, as set out in the Cryptoasset Terms which can be found above. The amount of Cryptoback Rewards that we hold on your behalf will be displayed to you in the "Rewards" section on your Wirex Profile.

5.2 The Cryptoback Rewards may be subject to tax in your jurisdiction. You are responsible for paying any tax due on any Cryptoback Rewards that you receive. You should seek professional advice if you are unsure about whether you need to pay any tax and/ or how much tax you need to pay.

6. Important limitations on your ability to obtain rewards

6.1 You will not be eligible for Cryptoback Rewards in respect of any purchases that are not Qualifying Purchases, including the following
(a) any purchases that you make with your Wirex Card online;
(b) any cash withdrawals (including ATM transactions and cashback); or
(c) any money transfers.

6.2 We reserve the right not to pay out any Cryptoback Rewards in the following cases:
(a) we have discontinued the Cryptoback Programme and you make the Qualifying Purchase after the date on which the Cryptoback Programme was discontinued;
(b) the Qualifying Purchase is refunded, reversed or cancelled by you, the merchant or any other person;
(c) we are prohibited from paying you any Cryptoback Rewards by applicable law.

6.3 We may also refuse to pay out any Cryptoback Rewards if:
(a) we reasonably suspect that any Qualifying Purchases have been made fraudulently;
(b) you have breached any provision in these Cryptoback Terms or our General Terms of Service,
and we may also take any other action we reasonably deem appropriate, including immediate, temporary or permanent withdrawal of your right to use the Wirex Service, the closure of your Wirex Profile or the cancellation of your Wirex Card.

6.4 The decision of Wirex in all matters relating to the Cryptoback Programme, the Cryptoback Rewards and these Cryptoback Terms is final and binding and no correspondence or discussion will be entered into.

7. Limitation of Liability

7.1 Wirex reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, the Cryptoback Programme with or without prior notice due to reasons outside its control (including, without limitation, in the case of anticipated, suspected or actual fraud).

7.2 We may also modify or discontinue the Cryptoback Programme on reasonable notice to you. If we discontinue the Cryptoback Programme, we will subject to paragraph 6.2, honour any Cryptoback Rewards for which you became eligible prior to 11:59 pm UK time on the last date of the Cryptoback Programme.

7.3 Wirex accepts no responsibility for any loss or damage incurred or suffered by you as a result of participating in the Cryptoback Programme or accepting or using any Cryptoback Reward, including (but not limited to) any loss resulting from the following:
(a) any postponement or cancellation of the Cryptoback Programme, or any delay in crediting any Cryptoback Rewards to your Wirex Profile;
(b) any alteration, unauthorised access, damage, late delivery or non-delivery of any notices, acceptances, requests or other documents related to the Cryptoback Programme;
(c) any damage to your or any other person's computer relating to or resulting from participation in the Cryptoback Programme;
(d) any act or default of any third party supplier.

7.4 Nothing in these Cryptoback Terms shall exclude the liability of Wirex for death, personal injury, fraud or fraudulent misrepresentation as a result of its negligence, or any other matter for which the law does not allow us to exclude or limit our liability.

9. General

9.1 We intend to rely on these Cryptoback Terms as setting out the written terms of our agreement with you for each of your participation in the Cryptoback Programme. If part of these Cryptoback Terms cannot be enforced then the remainder of the Cryptoback Terms will still apply to our relationship.

9.3 The Cryptoback Programme will be governed by English law. The English courts will have non-exclusive jurisdiction over any dispute arising from or related to Cryptoback Programme. This does not affect any rights you may have under the law of the country in which you are resident, including (where applicable) your right to have a dispute in relation to the Cryptoback Programme heard in the courts of that country.
