These Terms and Conditions ("Terms") govern the Wirex ETH Birthday Giveaway (the "Promotion"), offered by Wirex Digital Service S.r.l. except for all customers based outside of the European Economic Area, where the giveaway will be offered by Wirex Australia PTY Ltd (each separately referred to as "Wirex").
Definitions
“APAC” means Hong Kong, Taiwan, New Zealand, Australia, Thailand, and the Philippines.
“EEA” means the European Economic Area, a free-trade zone composed of the states of the European Union together with Iceland, Norway, and Liechtenstein.
“Eligible Participants” refers to individuals who are Wirex users and meet the requirements outlined in the Eligibility section of this Agreement.
“Giveaway Tweet” means the tweet from the official Wirex Twitter account explaining the instructions for the ETH Birthday Giveaway, including time restrictions and participation criteria.
"Promotion Criteria" denotes the conditions that must be satisfied for eligibility in the Promotion, as detailed in this Agreement.
“Working Days” means Monday to Friday, excluding weekends and any public holidays when the banks of England are closed for business.
Timescale
1. The giveaway will run for 120 hours (5 days), starting from 30th July 2025, 2 PM CET, and ending on 4th August 2025, 2 PM CET (“Promotion Period”). Entries submitted after this time will not be counted.
Eligibility
2. This Promotion is accessible to individuals who meet the following criteria:
Reside in the EEA or APAC, in a jurisdiction where participation is legally permitted. This Promotion is not open to residents of the UK or the USA, Singapore, Belgium and New Zealand.
Are at least 18 years of age and possess the legal capacity to enter into binding agreements in their jurisdiction.
Adhere to all relevant local, national, and international laws and regulations.
Have a fully verified/KYCed Wirex customer account.
No purchase or payment is necessary to enter or win this Promotion. Internet access and a valid Twitter/X account are required.
Wirex reserves the right to request proof of identity, eligibility and compliance with these Terms before awarding any prizes.
Participation Requirements
3. To qualify for the giveaway, Eligible Participants must:
Follow Wirex’s official Twitter account.
Like and retweet the Giveaway Tweet.
Quote this tweet saying “Believe in somETHing”
Tag 3 friends in the comment section of the giveaway tweet.
Multiple entries from the same person or Twitter/X account, or entries generated by automated means, or practices that unfairly advantage an entrant (e.g. the use of bots), are prohibited and will result in disqualification.
Participants may withdraw their entry from the Promotion at any time prior to the closing date by contacting: support.wirex@wirexapp.com.
Reward
4. The reward will be credited to 3 Eligible Participants who have met the Participation Requirements and are selected at random from all participants who have fulfilled the entry criteria for this Competition (the “Winner”).
5. The reward will be granted to 3 Eligible Participants who have met the Participation Requirements. Winners will be selected at random from all participants who have fulfilled the Participation Requirements during Promotion Period.
6. Winner will be contacted within 30 days of the end of the Promotion Period via Twitter by the official Wirex Twitter account and asked to provide details of their verified Wirex account to which the reward can be sent.
7. Each winner of the 3 will receive $50 worth of ETH equivalent to USD 50 at the time of transfer based on market exchange rates, credited to their verified Wirex account within 60 Working Days after the end of the Promotion Period. Wirex shall not be liable for any fluctuation in value of ETH after distribution. Any taxes or duties payable on the prize are the sole responsibility of the Winner.
8. By accepting the prize, each Winner consents to the use of their name, Twitter/X handle and likeness for promotional purposes in any media, worldwide, without additional payment or consideration, except where prohibited by law.
9. Wirex’s decision regarding the distribution of the reward is final and may be changed at any time at Wirex’s sole discretion.
General
10. Wirex’s verdict on the allocation of rewards is definitive and is made at its exclusive discretion.
11. Wirex reserves the right to disqualify any Eligible Participant found to be tampering with the entry process, submitting multiple entries, using fake accounts, or engaging in any form of fraudulent, deceptive or unethical conduct.
12. Entries containing obscene, offensive, discriminatory, defamatory or illegal content will be disqualified at Wirex’s sole discretion.
13. Wirex disclaims liability for any losses or damages resulting from participation in this Promotion.
14. Wirex reserves the right to amend these Terms or terminate the Promotion without prior notice.
15. Wirex shall not be liable for any failure to comply with these Terms where such failure is caused by events beyond its reasonable control, included but not limited to natural disasters, epidemics or pandemics, acts of government, war, civil commotion, or disruption of Twitter/X or other platforms used to facilitiate the Promotion.
16. Subject to applicable law, Wirex shall not, under any circumstances, be liable to compensate Wirex users or any other third parties for losses or damages incurred as a result of participation in this Promotion.
17. Where services are provided by Wirex Digital Services S.r.l., the Terms shall be governed by the laws of Croatia, with exclusive jurisdiction vested in the Italian courts. Where services are provided by Wirex PTE Ltd, the Terms shall be governed by the laws of Australia, with exclusive jurisdiction vested in the courts of Australia. In each case, the parties irrevocably agree that the designated courts shall have exclusive authority to hear, settle and/or determine any dispute, controversy or claim (including any non-contractual matters) arising out of or in connection with this Promotion.
18. By participating in this Giveaway, each Eligible Participant agrees for their personal information (e.g. username, forename, surname etc.) to be visible to other participants when engaging in Giveaway-related posts on Wirex’s social media platforms.
19. Wirex will only process personal data collected in connection with the Competition in accordance with its Privacy, Data Use and Retention Policy, available here: https://wirexapp.com/legal/row-privacy-data-retention, and applicable data protection laws, including the EU General Data Protection Regulation (GDPR), where applicable. By participating in this Promotion, participants consent to such processing of personal data for the purposes of administering the Promotion.
20. By accepting the prize, Winners consent to the use of their name, image and Twitter/X handle in marketing and promotional materials, unless prohibited by law.
21. These Terms constitute the complete agreement between participants and Wirex with respect to the Promotion and supersede all prior communications and understandings, whether written or verbal.
22. In the event of any dispute, controversy or claim arising out of relating to this Promotion or these Terms, the parties shall first seek to resolve the matter amicably through good faith negotiations. If unresolved, the dispute shall be subject to binding arbitration in accordance with the rules of the Italian courts for EEA users and the Australian courts for non-EEA users.
23. All intellectual property rights in materials provided in connection with this Promotion (including logos, branding and promotional content) remain the property of Wirex or its licensors. Participants may not use such materials without prior written consent.
24. If any provision of these Terms is found to be invalid or unenforceable by a court of law, the remaining provisions shall remain in full force and effect.
25. It is the responsibility of each Participant to ensure that participating in this Promotion does not violate any local laws and Wirex shall not be held liable for any breach of such laws by a Participant.
26. Wirex shall not be liable for any indirect, incidental, consequential, special or punitive damages arising out of or in connection with this Promotion.
27. By participating in this Promotion, Eligible Participants agree to be bound by these Terms and Conditions.
